Terms and Conditions / Reservation Agreement

These Terms and Conditions / Reservation Agreement apply to all reservations, transportation services, airport transfers, hourly services, point-to-point trips, group transportation, and related services provided by American Town Car, Inc. referred to in this Agreement as “American Town Car,” “Company,” “we,” “us,” or “our.”

By requesting, booking, confirming, paying for, or using transportation services provided by American Town Car, the client agrees to these Terms and Conditions on behalf of the client and all passengers included in the reservation.

For purposes of this Agreement, “client” means the person or entity booking, paying for, arranging, or using the service, including any passenger, travel arranger, company representative, or third party making the reservation.

All accepted reservations will be confirmed by email. A reservation is not valid unless American Town Car has issued a confirmation email.

Clients are responsible for reviewing the confirmation email and immediately notifying American Town Car of any errors, including errors involving date, time, pickup location, drop-off location, vehicle type, passenger count, luggage count, flight information, phone number, or special requests.

If you do not receive a confirmation email, please check your spam or junk folder and contact American Town Car immediately.

 

 

2. Acceptance of Terms

By booking or using American Town Car services, the client confirms that:

  1. The client has read and accepted these Terms and Conditions.
  2. The client is responsible for all passengers included in the reservation.
  3. The client has authority to accept these Terms on behalf of all passengers and, where applicable, any business or organization arranging the service.
  4. The client agrees to pay all charges authorized under this Agreement.
  5. The client understands that service is subject to vehicle availability, traffic, weather, road conditions, airport rules, and other circumstances outside American Town Car’s control.

If any part of this Agreement conflicts with applicable law, the law will control, and the remaining terms will remain in effect to the fullest extent permitted.

 

 

3. Reservation Information and Client Responsibility

The client is responsible for providing complete and accurate reservation information at the time of booking, including:

  • Passenger name;
  • Valid mobile phone number;
  • Pickup date and time;
  • Pickup and drop-off addresses;
  • Airline, flight number, and arrival or departure time for airport transportation;
  • Number of passengers;
  • Number, size, and type of luggage items;
  • Child safety seat or booster seat needs;
  • Pet or service-animal information, when applicable;
  • Accessibility requests or special accommodations;
  • Extra stops, route requests, or waiting-time needs.

American Town Car is not responsible for delays, missed pickups, no-show charges, additional fees, or service issues caused by incorrect, incomplete, delayed, or outdated information provided by the client.

Reservation changes are subject to availability. A change to pickup time, pickup location, destination, route, vehicle type, passenger count, luggage count, or service duration may result in a revised rate. Changes requested within the applicable cancellation window may be treated as a cancellation and new reservation.

 

 

4. Reservation Confirmation

A reservation is confirmed only when American Town Car sends a written confirmation by email.

Verbal quotes, online inquiries, phone discussions, or text messages do not create a confirmed reservation unless American Town Car issues written confirmation.

The client is responsible for confirming that all information in the reservation confirmation is accurate. Failure to correct inaccurate information before service may result in additional charges, delay, no-show classification, or cancellation without refund.

 

 

5. Rates, Payment, and Authorization to Charge

All services are subject to vehicle and chauffeur availability at the time of booking.

Full payment is required at the time of reservation unless American Town Car approves different billing terms in writing.

By booking a reservation, the client authorizes American Town Car to charge the credit card or payment method on file for all amounts due under this Agreement, including but not limited to:

  • Base fare;
  • Service fee;
  • Additional stops;
  • Waiting time;
  • Overtime;
  • After-hours surcharges;
  • Parking fees;
  • Tolls;
  • Airport fees;
  • Port, venue, or access fees;
  • Out-of-area travel charges;
  • Vehicle upgrade charges;
  • Cleaning fees;
  • Damage charges;
  • Late cancellation fees;
  • No-show fees;
  • Lost-item return costs;
  • Any other charges authorized by this Agreement or approved by the client.

If payment is declined, American Town Car may cancel the reservation, refuse service, or require an alternate valid payment method before service begins.

 

 

6. Service Fee and Gratuity

25% service fee applies to all reservations. This fee covers administrative costs, fuel, mileage, operational expenses, and related service costs.

Unless the reservation confirmation expressly states otherwise, the service fee is not chauffeur gratuity.

Chauffeur gratuity, if any, is separate and optional unless specifically included in writing in the reservation confirmation.

 

 

7. Out-of-Area, After-Hours, and Additional Charges

Additional charges may apply for pickups or drop-offs outside the Portland metropolitan area or outside American Town Car’s standard service area.

Out-of-area charges may include mileage, chauffeur travel time, vehicle positioning time, fuel, parking, tolls, lodging, meals, or other trip-related expenses when applicable.

A minimum surcharge of $25.00 applies to all pickups or drop-offs scheduled between:

10:30 PM and 5:30 AM

Holiday, special-event, high-demand, airport, venue, port, or access-related charges may apply when disclosed at booking or when incurred as part of the service.

 

 

8. PDX Airport Pickup Instructions

Unless an inside-terminal Meet and Greet service has been specifically requested, confirmed, and paid for, passengers arriving at Portland International Airport should:

  1. Proceed to baggage claim and collect all luggage.
  2. Follow current airport signage and American Town Car dispatch instructions to the designated limo/towncar pickup area.
  3. Look for the assigned chauffeur or vehicle displaying the passenger name.
  4. Call 503-530-9199 immediately if the chauffeur or vehicle cannot be located.

Airport pickup locations may change due to airport rules, construction, traffic control, security requirements, or Port of Portland instructions. Current airport signage, dispatch instructions, and airport-authorized pickup procedures will control over any older written pickup directions.

Passengers should not leave the airport or arrange alternate transportation without first contacting American Town Car. Leaving without contacting American Town Car may result in a no-show charge.

FlyPDX currently describes limo and towncar pickup as being on the lower roadway outside baggage claim, at the far end closest to the parking garage; however, the policy above keeps the wording flexible because airport pickup areas may change.  

 

 

9. Airport Waiting Time and No-Show Policy

American Town Car may monitor flight status when accurate airline and flight number information is provided.

If accurate flight information is provided, airport waiting time generally begins from the actual posted landing time or the confirmed pickup time, depending on the reservation. If accurate flight information is not provided, waiting time may begin from the scheduled pickup time listed in the confirmation.

Unless otherwise stated in writing, the following airport waiting time is included:

   Additional waiting time is subject to chauffeur and vehicle availability and may be charged at the applicable waiting-time rate.

An airport pickup may be classified as a no-show if the passenger:

  • Does not appear at the designated pickup location within the included waiting period;
  • Does not contact American Town Car within the included waiting period;
  • Leaves the airport without contacting American Town Car;
  • Provides incorrect flight information, contact information, or pickup details that prevent timely service;
  • Refuses service after the chauffeur has arrived; or
  • Uses alternate transportation without first contacting American Town Car.

Airport no-shows are charged 100% of the booked trip total.

 

 

10. Non-Airport Pickup Waiting Time and No-Show Policy

For non-airport pickups, the first 15 minutes after the scheduled pickup time are complimentary.

After the 15-minute grace period, waiting time will be charged as follows:

   A non-airport pickup may be classified as a no-show if the passenger does not appear, is not ready to depart, or does not contact American Town Car within 15 minutes after the scheduled pickup time.

Non-airport no-shows are charged 100% of the booked trip total.

If the chauffeur is able to wait beyond the grace period, waiting-time charges will apply. Waiting beyond the grace period is not guaranteed and depends on chauffeur availability, vehicle availability, and later reservations.

 

 

11. Hourly Service Waiting Time and No-Show Policy

Hourly service begins at the scheduled start time stated in the reservation confirmation, regardless of when the passenger enters the vehicle.

Late passenger arrival does not extend the reserved service period unless American Town Car approves an extension and the client agrees to pay additional charges.

If the passenger does not appear during the reserved hourly service period, the reservation may be classified as a no-show and charged 100% of the booked trip total.

Additional hourly time is subject to availability and may be billed in increments determined by American Town Car.

 

 

12. Extra Stops, Route Changes, and Extended Service

Extra stops are not included unless listed in the reservation confirmation.

Additional stops begin at $25.00 per stop. Final charges may vary based on time, mileage, route, vehicle type, parking, tolls, airport fees, and service impact.

American Town Car may decline unscheduled stops that:

  • Are not along the general route of travel;
  • Create a safety concern;
  • Violate applicable law;
  • Interfere with another reservation;
  • Materially change the original trip; or
  • Require more time than the reserved service allows.

If a stop exceeds 15 minutes, if multiple stops are added, or if the trip materially changes from the original itinerary, the reservation may be converted to hourly service or billed for additional waiting time, mileage, and related charges.

 

 

13. Passenger and Luggage Capacity

The client must accurately disclose the number of passengers and the amount of luggage at the time of booking.

American Town Car may refuse to transport passengers or luggage that exceed the safe or legal capacity of the reserved vehicle.

Every passenger must have an available seat belt. No passenger may ride without a seat belt where required by law.

If the reserved vehicle cannot safely or legally accommodate the passengers or luggage due to inaccurate booking information, American Town Car may offer a larger vehicle if available. Additional charges will apply. If no suitable vehicle is available, the reservation may be cancelled or treated as a late cancellation or no-show.

 

 

14. Seat Belts and Child Safety Seats

All passengers must comply with applicable seat-belt and child-restraint laws.

Clients traveling with children are responsible for providing legally required child safety seats, booster seats, or other child restraints unless American Town Car has agreed in writing to provide them.

The client is responsible for properly installing and securing any child safety seat or booster seat. Chauffeurs are not responsible for installing, inspecting, or confirming the legal sufficiency of child restraint systems.

American Town Car may refuse to begin or continue service if a child is not properly restrained or if the vehicle would be operated in violation of applicable safety laws.

Oregon ODOT states that safety restraints are required for occupants of privately owned commercial vehicles transporting 15 or fewer persons, including shuttles, taxis, limousines, and vans; ODOT also publishes Oregon child safety seat and booster seat requirements.  

 

 

15. Unaccompanied Minors

American Town Car does not transport unaccompanied minors unless the service has been approved in writing before the reservation.

A parent, guardian, or authorized adult is responsible for providing accurate information and ensuring that all legal and safety requirements are met.

American Town Car may refuse service if transporting a minor would create a legal, safety, or operational concern.

 

 

16. Passenger Conduct and Safety

The client is responsible for the conduct of all passengers.

Passengers must:

  • Follow chauffeur safety instructions;
  • Wear seat belts where required;
  • Refrain from interfering with the chauffeur;
  • Refrain from opening doors while the vehicle is moving;
  • Refrain from throwing objects from the vehicle;
  • Refrain from abusive, threatening, unsafe, or disorderly conduct;
  • Refrain from illegal activity;
  • Respect the vehicle and chauffeur;
  • Supervise minors at all times.

American Town Car may immediately refuse, suspend, or terminate service without refund if any passenger engages in unsafe conduct, illegal activity, harassment, threats, excessive intoxication, disorderly behavior, or any conduct that could endanger the chauffeur, passengers, vehicle, or public.

If service is terminated because of passenger conduct, the full fare remains due, and additional damage, cleaning, waiting-time, or return-transportation charges may apply.

 

 

17. No Smoking, Vaping, Alcohol, Cannabis, or Illegal Substances

Smoking, vaping, cannabis use, illegal substances, and alcohol consumption are strictly prohibited in all American Town Car vehicles.

Violations will result in the following charges:

   American Town Car may terminate service immediately without refund if this policy is violated.

Additional charges may apply for actual cleaning, repair, replacement, vehicle downtime, or lost revenue.

 

 

18. Pets and Service Animals

Pets are permitted only with advance notice and must be transported in a secured carrier unless American Town Car approves another arrangement in writing.

A cleaning fee of $495.00 will be charged if a pet is transported without a proper carrier, causes odor, sheds excessively, soils the vehicle, or requires additional cleaning.

This pet policy does not apply to qualified service animals protected by applicable disability laws. Qualified service animals are permitted without a carrier and without a pet fee.

American Town Car will not charge a pet fee, carrier fee, or cleaning fee solely because a passenger is accompanied by a qualified service animal. The service-animal handler is responsible for keeping the animal under control at all times. American Town Car may charge for actual damage caused by a service animal in the same manner it charges for damage caused by passengers or other animals.

Emotional support animals, comfort animals, therapy animals, and pets that are not qualified service animals may be treated as pets unless applicable law requires otherwise.

ADA guidance states that service animals are not pets, that transportation providers such as taxicabs, shuttles, and limousine services may not deny transportation because of a service animal, and that businesses may charge for actual damage caused by a service animal if they normally charge customers for damage.  

 

 

19. Vehicle Damage and Excessive Cleaning

The client is financially responsible for all damage, excessive cleaning, contamination, or loss caused by the client or any passenger in the party.

A minimum cleaning fee of $395.00 applies for excessive cleaning, including but not limited to:

  • Vomit;
  • Spills;
  • Bodily fluids;
  • Food mess;
  • Strong odors;
  • Pet-related cleaning;
  • Trash or debris beyond normal use;
  • Stains;
  • Biohazard cleaning;
  • Any condition requiring the vehicle to be removed from service.

The listed cleaning fee is a minimum charge. Actual charges may be higher depending on the severity of the incident and may include:

  • Cleaning;
  • Sanitizing;
  • Detailing;
  • Repair;
  • Replacement parts;
  • Upholstery or carpet repair;
  • Burn repair;
  • Odor removal;
  • Biohazard treatment;
  • Vehicle downtime;
  • Lost revenue;
  • Administrative costs;
  • Third-party vendor charges.

Damage charges will be assessed after inspection. American Town Car may charge the payment method on file after completing a reasonable assessment.

Documentation may include photos, videos, internal incident reports, repair estimates, vendor invoices, cleaning records, or other reasonable evidence. Cleaning may be performed internally by American Town Car or by a third-party vendor. Third-party receipts may not be available for internally performed cleaning or repairs.

 

 

20. Personal Belongings

American Town Car is not responsible for lost, stolen, damaged, or left-behind personal belongings.

Clients and passengers are responsible for checking the vehicle before exiting.

If you believe you left an item in a vehicle, contact American Town Car immediately at 503-530-9199. American Town Car will make reasonable efforts to locate and return the item.

The client is responsible for any shipping, courier, delivery, storage, or chauffeur-time costs associated with returning lost property.

 

 

21. Vehicle Substitution and Availability

American Town Car reserves the right to substitute or upgrade vehicles at its discretion in order to fulfill a reservation.

If the originally requested vehicle is unavailable due to mechanical issues, scheduling conflicts, safety concerns, fleet needs, affiliate availability, emergency conditions, or circumstances beyond American Town Car’s control, American Town Car may provide a vehicle of similar or greater passenger capacity when available.

Specific vehicle makes, models, colors, license plates, amenities, or chauffeurs are not guaranteed unless expressly confirmed in writing.

A vehicle substitution does not automatically entitle the client to a refund if the substituted vehicle reasonably accommodates the confirmed passenger and luggage requirements.

 

 

22. Affiliate or Partner Service Providers

American Town Car may use qualified affiliate or partner transportation providers when necessary or appropriate to fulfill a reservation.

When affiliate or partner providers are used, these Terms and Conditions remain applicable to the reservation unless otherwise stated in writing.

American Town Car will make reasonable efforts to use professional providers; however, service may also be subject to airport, municipal, affiliate, or provider-specific rules.

 

 

23. Accessibility and Special Accommodations

Clients are encouraged to notify American Town Car of accessibility needs, mobility devices, medical equipment, or special assistance requests at the time of booking so that reasonable arrangements can be made when available.

Advance notice is not required for qualified service animals.

American Town Car will make reasonable efforts to accommodate accessibility requests consistent with applicable law, vehicle availability, safety requirements, and operational limitations.

American Town Car may refuse to transport equipment or items that cannot be safely loaded, secured, or accommodated in the reserved vehicle.

 

 

24. Cancellation Policy

To maintain vehicle availability and service quality, the following cancellation policy applies.

A phone call may be used for urgent assistance, but a cancellation is not effective unless received and confirmed by American Town Car in writing.

   Reservations made within the applicable cancellation window are fully non-refundable.

For purposes of this policy, “booked trip total” includes the base fare, service fee, vehicle charges, confirmed add-ons, and any costs already incurred by American Town Car.

Cancellation requests are measured from the scheduled pickup time unless the reservation confirmation states otherwise.

Special events, holidays, weddings, proms, wine tours, long-distance trips, multi-vehicle reservations, affiliate reservations, and custom transportation arrangements may have stricter cancellation terms. Any stricter or special cancellation terms must be stated in the reservation confirmation or separate written agreement.

 

 

25. Reservation Changes Within the Cancellation Window

Changes requested within the applicable cancellation window are subject to availability and may result in additional charges.

American Town Car is not required to approve changes requested within the cancellation window.

A material change requested within the cancellation window may be treated as a cancellation and new reservation. Material changes include, but are not limited to:

  • Changing pickup time;
  • Changing pickup location;
  • Changing destination;
  • Adding stops;
  • Extending service duration;
  • Changing vehicle type;
  • Increasing passenger count;
  • Increasing luggage count;
  • Changing from point-to-point to hourly service;
  • Changing the service date.

If American Town Car cannot accommodate the requested change, the original cancellation policy remains applicable.

 

 

26. Refunds

Approved refunds will be issued to the original payment method unless American Town Car agrees otherwise in writing.

Refund processing time may depend on the payment processor, bank, or credit card issuer.

Service fees, no-show charges, late cancellation charges, affiliate costs, airport fees, parking fees, tolls, and other costs already incurred may be non-refundable.

No refund will be issued for unused service time, passenger delay, early termination due to passenger conduct, inaccurate reservation information, or voluntary cancellation within the applicable cancellation window.

 

 

27. Billing Disputes

Billing questions or disputes must be submitted in writing to info@americantowncar.net within 7 days after the charge appears.

The client must identify the disputed charge and provide a clear explanation of the dispute.

American Town Car will review billing disputes in good faith. Submitting a billing dispute does not suspend the client’s responsibility for undisputed amounts.

Nothing in this section limits any non-waivable rights the client may have under applicable law.

 

 

28. Delays, Road Conditions, and Travel Time

American Town Car will make reasonable efforts to provide timely service; however, pickup times, arrival times, and travel times are not guaranteed.

American Town Car is not responsible for delays, missed flights, missed appointments, missed events, loss of business, or related losses caused by:

  • Weather;
  • Traffic;
  • Road closures;
  • Accidents;
  • Construction;
  • Airport congestion;
  • Security delays;
  • Law enforcement activity;
  • Incorrect reservation information;
  • Passenger delay;
  • Mechanical issues;
  • Detours;
  • Special events;
  • Natural disasters;
  • Government action;
  • Circumstances beyond American Town Car’s reasonable control.

Clients are responsible for selecting pickup times that allow sufficient travel time. Chauffeurs may select routes based on safety, traffic, weather, road conditions, airport rules, and efficiency. Route requests will be accommodated when reasonable but are not guaranteed.

 

 

29. Mechanical Issues and Service Interruptions

In the event of a mechanical issue, vehicle breakdown, chauffeur emergency, accident, or other service interruption, American Town Car will make reasonable efforts to provide a substitute vehicle, alternate chauffeur, affiliate vehicle, or other practical solution.

American Town Car’s liability for a service interruption is limited to the amount paid for the affected service, except where prohibited by law.

American Town Car is not liable for indirect, incidental, consequential, special, or punitive damages, including missed flights, missed events, lost profits, lost opportunities, or inconvenience.

 

 

30. Right to Refuse or Terminate Service

American Town Car reserves the right to refuse, suspend, or terminate service when reasonably necessary due to:

  • Unsafe conditions;
  • Passenger misconduct;
  • Illegal activity;
  • Threats, harassment, or abusive behavior;
  • Excessive intoxication;
  • Vehicle overcapacity;
  • Excess luggage;
  • Lack of legally required child restraints;
  • Refusal to wear required safety restraints;
  • Smoking, vaping, alcohol, cannabis, or illegal substance violations;
  • Unpaid balances;
  • Invalid or declined payment;
  • Service requests that violate law or airport rules;
  • Any condition that could endanger the chauffeur, passengers, vehicle, or public.

If service is refused or terminated due to the conduct, condition, or actions of the client or passengers, the full booked trip total remains due.

 

 

31. Privacy and Use of Customer Information

American Town Car collects customer information for reservation, dispatch, billing, communication, safety, customer service, and legal compliance purposes.

Customer information may be shared with chauffeurs, dispatchers, payment processors, affiliates, service providers, insurance representatives, or legal/regulatory authorities as reasonably necessary to provide service, process payment, resolve disputes, comply with law, or protect American Town Car’s rights.

American Town Car does not sell customer information.

By providing a phone number or email address, the client agrees that American Town Car may contact the client regarding reservations, confirmations, chauffeur information, pickup instructions, billing, lost property, or service-related issues. Message and data rates may apply.

 

 

32. Compliance With Laws and Airport Rules

All services are subject to applicable federal, state, local, airport, port, and venue rules.

American Town Car may modify pickup procedures, routes, staging, waiting locations, or service instructions as required by law, airport authority, security personnel, traffic control, or venue management.

The client and passengers must comply with all applicable laws and lawful instructions from chauffeurs, airport personnel, venue personnel, and public authorities.

 

 

33. Limitation of Liability

To the fullest extent permitted by law, American Town Car is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to transportation services, including but not limited to missed flights, missed appointments, missed events, lost profits, loss of business, emotional distress, inconvenience, or alternate transportation costs.

Except where prohibited by law, American Town Car’s total liability for any claim arising from a reservation or service is limited to the amount paid to American Town Car for the affected service.

Nothing in this Agreement limits liability where such limitation is prohibited by applicable law.

 

 

34. Indemnification

To the fullest extent permitted by law, the client agrees to indemnify and hold harmless American Town Car, its owners, officers, employees, chauffeurs, contractors, affiliates, and agents from claims, damages, losses, costs, expenses, and liabilities arising from:

  • Passenger conduct;
  • Vehicle damage;
  • Excessive cleaning;
  • Incorrect reservation information;
  • Violation of this Agreement;
  • Illegal activity;
  • Injury or damage caused by the client, passengers, pets, luggage, or personal property;
  • Claims by passengers or third parties arising from the client’s reservation.

This section does not apply to the extent a claim is caused by American Town Car’s gross negligence, willful misconduct, or conduct for which indemnification is prohibited by law.

 

 

35. Governing Law

These Terms and Conditions are governed by the laws of the State of Oregon, without regard to conflict-of-law rules.

Any dispute arising from or related to these Terms, a reservation, or transportation service shall be brought in a court of competent jurisdiction in Oregon, unless applicable law requires otherwise.

 

 

36. Severability

If any provision of this Agreement is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable, if permitted by law.

 

 

37. No Waiver

Failure by American Town Car to enforce any provision of this Agreement does not waive the right to enforce that provision later.

Any waiver must be in writing and signed by American Town Car.

 

 

38. Entire Agreement

These Terms and Conditions, together with the reservation confirmation and any written addendum issued by American Town Car, constitute the entire agreement between the client and American Town Car regarding the reservation.

If there is a conflict between the reservation confirmation and these Terms, the reservation confirmation will control only for trip-specific details such as date, time, vehicle type, pickup location, destination, and price. These Terms control all general policies unless American Town Car expressly agrees otherwise in writing.

 

 

39. Updates to Terms

American Town Car may update these Terms and Conditions from time to time.

The version in effect at the time of booking will generally apply to the reservation unless a change is required by law, airport rule, safety requirement, or written agreement.

 

 

40. Final Acknowledgment

By booking, confirming, paying for, or using American Town Car services, the client acknowledges that the client has read, understood, and agreed to these Terms and Conditions.

The client accepts responsibility for all passengers included in the reservation and for all charges authorized under this Agreement.
